Singapore Safety Glass (SSG®) does not warrant and hereby disclaims any warranty as to the accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the following Limited Warranty Information.
Limited Warranty Information
Singapore Safety Glass Pte. Ltd. with its registered address at 112 Pioneer Road, Singapore 639593 (“SSG”) warrants that each product manufactured, sold and delivered by SSG shall be manufactured to the standard set out in our Invitation read with our terms and conditions (Annex A) for the type of glass ordered by the buyer. The express limited warranty stated herein is exclusive and is in lieu of and replaces any and all other warranties, representations or conditions of any kind, whether written, oral or implied (including, without limitation, any implied warranties, representations or conditions or merchantability or fitness for a particular purpose, statutory or otherwise), and supersedes any oral or written warranties, representations or conditions made, asserted or implied by any distributor, agent, representative or employee or contained in any manual, brochure, literature, advertising or other materials. No distributor, agent, representative or employee has the authority to change, alter, amend or otherwise modify this limited warranty.
SSG undertakes to provide free-of-charge, ex-factory, replacement of its glass panels, in the event that the said glass panels have been proven to have failed in normal use and defective manufacture or materials for the specified period from the date of manufacture. The warranty for replacement glass panels will extend for the remainder of the warranty period for the original glass panels.
For laminated glass, “edge-blemish” shall be accepted if it is less than 15mm from the edge of the glass. Glass breakage, including but not limited to thermal breakage, is specifically excluded from all SSG’s product warranties.
If the product is no longer available, we will either replace it with a suitable glass type at the sole discretion of Singapore Safety Glass Pte. Ltd. or refund the purchase price of the glass. The replacement glass will be produced with the same quality standard as the one supplied and in compliance with the above-mentioned standard set out in our Invitation for the type of glass ordered by the buyer.
Singapore Safety Glass Pte. Ltd. specifically disclaims responsibility for any damage to any product caused by, or which results from, improper use or handling, shipping, installation not in accordance to normal industry standard, faulty building construction or design, building materials used or applied on glass that has adverse effects on the products, exposure to adverse environmental conditions including but not limited to alkalis, acids or sharp objects or works that may have a detrimental effect on the glass, improper cleaning practices or the occurrence of any event of force majeure. All claims pursuant to this warranty shall be presented in writing by the buyer of the products within seven (7) days of the buyer learning the facts upon which the claim is based. No warranty claim may be made after the passage of the applicable warranty period.
The remedies provided herein and in Singapore Safety Glass Pte. Ltd.’s contract/invoice for the products constitute the buyer’s sole and exclusive remedy under any claim in respect of Singapore Safety Glass Pte. Ltd.’s manufacture, sale or provision of the product or any warranty in connection therewith, including without limitation, claims based upon failure of, or defect in the product, whether a claim, however instituted, is based upon contract, indemnity, breach of warranty, tort or otherwise. Singapore Safety Glass Pte. Ltd. shall not be liable for consequential, indirect, incidental, punitive, exemplary or special damages, claims or costs of any nature including, without limitation, loss of use, loss of profit, labor costs of any kind relating to the removal of failed products or damages, claims or costs otherwise arising from or in connection with, alleged breach of any limited warranty or negligence on the part of the SSG.
This warranty is not assignable and shall be governed by the laws of Singapore. In case of any disputes which cannot be settled amicably, the responsible Court of Jurisdiction will exclusively be the Courts of Singapore. Singapore Safety Glass Pte. Ltd. shall not be liable for any other expenses involved in the removal of failed panels, personal injury, loss, claims, property damages, labor, material or any other incidental or consequential damages whether directly or indirectly.
Modification or alteration of this warranty is not valid unless under special request on a case by case basis and authorized in writing by a director of Singapore Safety Glass Pte. Ltd.
This warranty shall not apply if payment for the product supplied is not made in full to Singapore Safety Glass Pte. Ltd. by the due date thereof.
Any claims made under this warranty must be supported with a detailed report with proof of defective manufacture or materials while the warranty period is still in force.
All warranty must be made on an official Singapore Safety Glass Pte. Ltd. letterhead and signed by the director of the company.
